The Islamic Ruling Concerning the Criminal Act of Zina

In today’s English, the word used for a married person who engages in unlawful sexual intercourse is adultery; the single person who engages in sexual intercourse is fornication.  Unlike English, Arabic has only one word for both cases – zina.   A person has committed zina if they voluntarily and deliberately perform sexual intercourse with other than one’s spouse.

The Qur’anic injunctions with regards to those commit zina were revealed gradually, that is, bit by bit.  The first revelation concerning the punishment of zina was that a woman guilty of zina was to be confined to their home until she died.  The second revelation covered both men and women and was a little specific regarding punishment.  Allah (S.W.T) then revealed:

The woman and the man guilty of illegal sexual intercourse, flog each of them with a hundred stripes.  Let not pity withhold you in their case, in a punishment prescribed by Allah, if you believe in Allah and the Last Day…

The Messenger of Allah (S.A.W) clarified this injunction by saying:

“Take from me; Allah has made a decree for them.  A virgin (committing zina) with a virgin: one hundred lashes (for each) and exiling for year (for the man).  And a married (committing zina) with a married: one hundred lashes and stoning.”

One of the effects of zina is that it earns the wrath of Allah because His sacred limits are transgressed. Another of the effects of zina is that it takes away the goodness which Allah described as the attribute of those who are chaste, and replaces it with the evil which Allah described as the attribute of the adulterers, as Allah says:

Bad statements are for bad people (or bad women for bad men) and bad people for bad statements (or bad men for bad women). Good statements are for good people (or good women for good men) and good people for good statements (or good men for good women)”

Difference of opinion exists among Muslim jurists concerning the combining of both stoning and lashing.  There are also different opinions regarding the exiling of women.  The penal punishment of a married adulterer under Islamic jurisdiction is by stoning to death, as per the preceding hadith and other hadiths. Ibn Mus ‘ud (r.a) reported that Allah’s Messenger (S.A.W) said:

The blood of a Muslim, who testifies that there is no (true) god except Allah and that I am Allah’s Messenger, does not become permissible except for one of three acts: a married person who commitszina, one soul for another (killed) soul, and a man who abandons his deen (religion) and departs from the Jamaa ‘ah (of Muslims).”

The Prophet (S.A.W) applied stoning to a number of people during his time. Know that punishment for the crime of zina acts an atonement of this sin.  The Prophet (S.A.W) said regarding the woman from Ghamid who was stoned to death:

“She has repented such a repentance that, were it to be divided among seventy of Madina’s residents it would cover them.  Have you seen a better repentance than her giving away herself for Allah.”

The punishment of those who die without repenting from zina begins in their grave.  As for punishment in the hereafter, Allah Most High says:

“And they (i.e. the servants of Allah) do not commit zina - And whoever does this shall meet a full penalty.  The torment will be doubled to him on the Day of Resurrection, and he will abide therein in disgrace.”

One might think that the only way a person guilty of zina can be forgiven is by being awarded the penal punishment (hadd).  The scholars have said that a person who commits a sin should repent between himself and Allah (S.W.T).  The repentance will not be accepted if it is done during the pangs of death, as Allah Most High says:

“And of no effect is the repentance of those who continue to do evil deeds until death faces one of them and says: ‘Now I repent’….”

The Messenger of Allah (S.A.W) informed us in the hadith collected by Muslim:

“Whoever repents, before the sun rises from it’s setting (i.e. the west), Allah will forgive him.”

There are many actions a Muslim can do to protect themselves from zina.
1.      Salaat, both obligatory and supererogatory is one of the strongest fortresses against zina.  Allah (S.W.T) said:

“…and establish prayer, indeed prayer prevents from depravity and wrongdoing….”

2.      Regular fasting is another way of suppressing the sexual desire, as Allah’s Apostle (S.A.W) prescribed it for the young people who cannot afford marriage.

We ask Allah Most High to protect us from the evil of zina, accept our righteous actions, and shower us from His bounties in this life and in the Hereafter. And Allah knows best.

7.      Play the role of a Da’ee with passion and sympathy.

Can I Listen to Islamic Nasheeds?

What is the ruling on Nasheeds commonly amongst many of the youth, which they call 'Islamic Nasheeds'? If these Nasheeds have Islamic meanings whilst not having in them any musical instruments such as duffs, other drums, then there is no problem in this.

Likewise, it diverts them from seeking beneficial knowledge and calling to Allah.

Sources of Islamic Law

Islam has given the most comprehensive legal system to mankind. Islamic law covers all aspects of life. Islam has its own personal, civil, criminal, mercantile, evidence, constitutional and international law.

Islamic law has, therefore, not been given by any ruler, remains valid whether recognised by the State or not. The basic source of Islamic law is Divine Revelation:

1. The direct word of Allah, the Quran, is the primary source containing all the fundamental directives and instructions of Allah, is not only a book of law.

2. The Sunnah. The Prophet always acted according to the instructions of Allah. The Sunnah is an Arabic word which means "Method". The Quran says,

"For you the life of the Prophet is a model of behaviour" (Al-Quran 33:21)

Many of books of traditions were compiled by the companions of the Prophet. The Quran and Sunnah are complementary. The Sunnah explains the instructions of the Quran. The Quran and the Sunnah are the primary sources of Islamic law.

Ijma and Qiyas derive their value from the Quran and the Sunnah. Qiyas is the fourth important source of Islamic law, means analogy. The scholars have developed detailed principles of analogical deductions in the books of Islamic jurisprudence.

The Prophet has permitted Ijtihad which literally means 'to exert', is the Islamic method of facing the new situations and problems in the light of the general principles of the book of Allah, the Quran and the traditions of the Prophet.

How to Become a Muslim

All praise be to Allah, the Lord of the universe. For Allah, Almighty, is above all comprehension and knows well the secrets of all hearts. If anyone has a real desire to become a Muslim and has full conviction and strong belief that Islam is the true religion ordained by Allah for all human-beings, then, one should pronounce the “Shahada”, the testimony of faith, without further delay. The Holy Qur’an is explicit on this regard as Allah states:

“The Religion in the sight of Allah is Islam.” (Qur’an 3:19)

In another verse of the Holy Qur’an, Allah states:

“If anyone desires a religion other than Islam (Submission to Allah), Never will it be accepted of him; and in the Hereafter he will be in the ranks of those who have lost (their selves in the hell fire).” (Qur’an 3:85)

In addition, Islam is the only religion prevailing over all other religions. Allah states in the Holy Qur’an:

“To thee We sent the Scripture in truth, confirming the scripture that came before it, and guarding it in safety:…” (Qur’an 5:48)

Mohammad, the Prophet of Allah, said:

“The superstructure of Islam is raised on five (pillars): testifying that there is no God (none truely to be worshiped) but Allah, and that Mohammad is the messenger of Allah, performing the prayer, paying the Zakah (poor-due), fasting the month of Ramadan, and performing Hadj.”

The Shahada can be declared as follows:

“Ash-hadu anla elaha illa-allah wa ash-hadu anna muhammadan rasul-allah”.

The English translation is:

“I bear witness that there is no deity (worthy of worship) but Allah, and I bear witness that Muhammad is the Messenger of Allah.”

The significant point which every Muslim must know very well is the truth that there is no God to be worshipped other than Allah. Man must worship Allah, Who alone is worthy of worship.

Worship simply means rendering sincere service, showing reverence for Allah, into two categories:

1. Visible worship includes acts such as uttering the two parts of the “Shahada”, performing prayers, giving Zakah, recitation of the Holy Qur’an, supplication, adoring Allah by praising Him, purifying our bodies before prayers, etc. This type of worship is associated with movement of the parts of the human body.

2. Invisible worship is to believe in Allah, in the Day of Judgement, in the Angels, in the Books of Allah, in the Prophets of Allah, in the Divine Decree of destiny.

Allah states in the Holy Qur’an:

“… whoever rejects evil and believes in Allah hath grasped the most trustworthy Hand-hold, that never breaks…” (Qur’an 2:256).

We have to consider that when we declare from our heart that “there is no god worthy to be worshipped but Allah”, it implies on our part love, devotion, faith and obedience to the rules of Islamic legislations which are legally binding on all Muslims. It is a requirement of “there is no god worthy to be worshipped but Allah” to love and reject for the sake of Allah.

HAS ALLAH NOT GIVEN US THE RESOURCES?

Excellent resources on Allah by mahussain3

Recognize how many important resources are within Muslim control.

§ 70% of world oil reserves, totaling 550 billion barrels, are in "Muslim countries."

§ 49% of the world's Natural Gas reserves, totaling 2532 trillion cubic feet, are in Muslim majority countries.

§ 21% of world production of Uranium, totaling 6,421 tons annually, is from "Muslim countries."

The Prophet said: "People share in three things--The water, the graze, and the fire (includes power resources)" (Abu Dawud)

This hadith establishes public ownership of the natural resources in the Islamic State. If money from the Ummah's resources today were distributed according to Allah's Laws, nobody in the Islamic State would be living below poverty level. For example, 717-720 C.E: Khalifa Omar ibn Abdul-Aziz: Under the Khalifa's guardianship, there was no poverty in the Islamic State.

What we lack is the proper organization of the State. The longer we delay in implementing this solution, the more will our resources be wasted in mismanagement and extortion, and the longer the Muslim Ummah suffers.

Marhaban Ya Ramadhan....

May Allah gives me the strength to carry on with my fasting till the end of this holy month.
May my son to be a good Moslem.
May Allah accepts what little deeds I am able to do at this time of my life.
May the Ummah to unite in peace and harmony, and for mankind to establish peace amongst them.
